Terms and Conditions for Heroes Advertising

1. Introduction

These Terms and Conditions govern your use of the Heroes Advertising website (https://heroesadvertising.co.za/) and our advertising services. By accessing our website or engaging our services, you agree to these Terms and all applicable South African laws, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

2. Services Overview

Heroes Advertising specializes in:

  • Supplying free branded sugar sachets to restaurants for every booking received and approved by advertiser and Heroes Advertising
  • Connecting advertisers with venues through targeted advertising campaigns in line with brand values
  • Custom sugar sachet orders for specific marketing needs
Heroes Advertising reserves the right to reject, remove, or decline any campaign, artwork, product, or brand that does not align with the company’s platform standards, venue requirements, or family-friendly advertising guidelines.

3. User Obligations

By using our services, you agree:

  • To provide accurate information when registering or placing orders
  • Not to use our services for unlawful purposes
  • Not to interfere with website operations or other users’ access
  • To comply with all applicable advertising standards and regulations

4. Intellectual Property

All content on our website, including:

  • Logos
  • Branding
  • Proprietary advertising methods
  • Website design
  • Marketing materials

are owned by or licensed to Heroes Advertising and protected under South African and international copyright laws. Unauthorized use may violate intellectual property rights.

5. Ordering Process

For custom sachet orders:

  1. Submit your design specifications through our website
  2. We will provide a quote within 3 business days
  3. Payment of printing deposit is required to commence production
  4. Balance payable upon completion before delivery

Heroes Advertising reserves the right to reject, remove, or decline any campaign, artwork, product, or brand that does not align with the company’s platform standards, venue requirements, or family-friendly advertising guidelines.

6. Pricing and Payment

  • Prices are in South African Rand (ZAR) and exclusive of VAT
  • We accept EFTs.
  • Late payments incur interest at 2% above prime rate

7. Delivery

  • Free deliveries apply to standard branded sachet campaigns within Gauteng.
  • Custom orders may incur delivery charges based on location
  • Delivery times are estimates only and not guaranteed
  • Risk passes to customer upon delivery

8. Returns and Refunds

Due to the custom nature of our products:

  • No returns accepted for custom printed sachets
  • Defective products will be replaced at our discretion
  • Campaign are payable upfront and no refunds will be issued once printed and packed.

9. Limitation of Liability

Heroes Advertising shall not be liable for:

  • Indirect, consequential, or incidental damages
  • Losses arising from circumstances beyond our reasonable control
  • Any amount exceeding the fees paid for the specific service in question

10. Privacy

Our Privacy Policy (available on our website) explains how we collect, use, and protect your personal information in compliance with POPIA.

11. Dispute Resolution

Any disputes shall:

  1. First be attempted to resolve through good faith negotiations
  2. If unresolved within 30 days, be referred to mediation
  3. As a last resort, be subject to the jurisdiction of South African courts

We reserve the right to modify these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of South Africa.
